Settify respects your privacy and is committed to protecting your personal data. This privacy notice will inform you as to how we look after your personal data when you use our system and tell you about your privacy rights and how the law protects you.

Who we are

The Settify product and brand is owned and operated by Settify Pty Ltd (ABN 75 613 076 574).

Settify is an Australian legal technology company. We have worked with a range law firms to develop the online system that you are using.

Law firms who use our service may have their own privacy policy which can be accessed from their website.

Settify's collaboration with Law Firms

We provide online induction systems to law firms and collect your personal information from you on their behalf. We only disclose that personal information to law firms that you expressly ask us to do so, done by booking an appointment during the induction process.

When you are ready to book an appointment, we will provide firms with your name, address, and date of birth, and your spouse's name, address, and date of birth. A law firm will use that information to see whether they can act for you and .

If the law firm can act for you, we provide them with the rest of your information. If the law firm can't act for you, they will have no access to the rest of your information.

Legal protection of your information

As with any lawyer-client relationship, the information you provide is confidential, and you retain ownership of the information. Communications made through this website may also be subject to legal professional privilege, meaning they do not have to be disclosed to third parties who might seek the information (this is a good thing).

Security

The security of your Personal Data is very important to us. We will ensure that we have in place appropriate technical and organisational measures to prevent unauthorised or unlawful processing of Personal Data and against accidental loss or destruction of, or damage to Personal Data.

The information we collect

We collect the following types of personal information:

  • Contact details such as your name, mailing or street address, email address, telephone number and other contact details, age or date of birth, etc;
  • Information used to brief your lawyers including information about your relationship, information about your children, and information about your financial situation;
  • Information about how you use our system such as your device ID, device type, geo-location information, computer and connection information, statistics on page views, traffic to and from the sites, IP address and standard web log information;
  • Details of the products and services we have provided to you or that you have enquired about, including any additional information necessary to deliver those products and services and respond to your enquiries;
  • Additional information relating to you that you provide to us directly through our website or app or indirectly through your use of our website or app or online presence or through other websites or accounts from which you permit us to collect information;
  • Survey information you provide to us through customer surveys.

We collect these types of personal information directly from you via our interactive online system. We collect this information when you use our website or if you contact us.

How we process your information

We will process your information in accordance with the Personal Information Protection and Electronic Documents Act 2000. This means we will keep personal data up to date; store and destroy it securely; do not collect or retain excessive amounts of data; protect it from loss, misuse, unauthorised access and disclosure; and ensure that appropriate technical measures are in place to protect personal data.

The legal basis for us to process your information

We process your data with your express consent. We will ask you for that consent before we process your data. You are under no obligation to give consent if we ask for it. If you give consent you may withdraw it at any time.

Our service operates across four regions and utilises AWS cloud service to keep data stored in one of the regions your law firm operates in, or near.

  • Australia / New Zealand (ap-southeast-2)
  • Europe / Great Britain (ew-west-2)
  • Canada (ca-central-1)
  • USA (us-west-2)

How we use your information

We primarily use your information to prepare a brief for your lawyers, so that they can quickly understand the key issues in your legal matter.

So that we can provide a good service to you and to Law Firms, we also use your information to provide tech support, billing, record keeping, and providing reports on usage. We may collate, process, disseminate and publish statistics based on an aggregation of data held on our files provided the data relating to any individual may not be identified from the resulting analysis.

How long we store your information for

We store your information for 60 days, so that you and Law Firms can come back to it. Then 60 days after you or Law Firms have last accessed your information, we freeze your information and make it inaccessible from the cloud. Your information can be made cloud-accessible again if you contact us to request it. We store your information in ‘deep freeze' and off the cloud for 2 years, after which time all identifying information is permanently destroyed. An anonymised version of the data is retained indefinitely.

In certain situations, we will transfer some of your information to another region

Settify has offices and staff in regions across the globe. We will transfer only your data to those regions on an ‘as required' basis, and it will only be transferred to so that we can provide support, and use basic information required for billing and invoicing.

As we transfer personal data outside our hosting regions in limited circumstances, any transfer of personal data outside your region will:

  • be internal only (to other Settify personnel rather than other entities)
  • occur within the one legal entity (rather than between entities in the same group)
  • be for limited purposes, and limited duration
  • subject to numerous safeguards

Sharing your information

If you complete the questions on our product, we may provide your information to law firms, but only where you have given us permission to do so.

We take your privacy seriously, and only disclose information to the extent required to enable us to provide our service to you. We may disclose your personal information for the purposes described in this privacy policy to:

  • Law firms or third parties that you expressly request that we disclose your information to;
  • our employees;
  • anyone to whom our assets or businesses (or any part of them) are transferred, provided that they agree to deal with your personal information in a manner consistent with the terms of this Privacy Policy;
  • other persons, including government agencies, regulatory bodies and law enforcement agencies, or as required, authorised or permitted by law.

Your rights in relation to your information

You have the right to:

  • Request access to your personal data. This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it. You can also self-serve by viewing the answers you provided by logging back in to our system.
  • Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected. You can also self-serve by changing the answers you provided by logging back in to our system.
  • Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
  • Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
  • Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios:
    • if you want us to establish the data's accuracy;
    • where our use of the data is unlawful, but you do not want us to erase it;
    • where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or
    • you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.
  • Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in the form of a PDF brief.
  • Withdraw consent at any time, where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

We do not use automated decision-making or profiling

It is conceivable that the firms we work with will use automated decision-making or profiling which relies on the information we provide them. You should refer to law firm's own privacy policy if you are concerned about that.

Changes to this Privacy notice

We may make changes to our Privacy Notice from time to time. When we do so we will place our changed Privacy Notice on the website www.settify.ca. We will make clear any changes we have made to our changed Privacy Notice. We will always put the date of our Privacy Notice in its heading so that you can easily find this information.

Cookies Policy

We use a system of classifying the different types of cookies which we use on the Website, or which may be used by third parties through our websites. The classification was developed by the International Chamber of Commerce UK and explains more about which cookies we use, why we use them, and the functionality you will lose if you decide you don't want to have them on your device.
